Terms & Conditions for the Introduction of Permanent Staff

1 Definitions:

Abrecco Any representative of the Abrecco group of companies their subsidiaries or agents
Client The person, firm or corporate body engaging Abrecco to introduce staff
Candidate Individual(s) introduced to the Client by Abrecco
Introduction The provision of the name or CV of a Candidate currently seeking employment to the Client
Engagement The employment or use of the Candidate by the Client, under a contract of service or for services, partnership, as agent, distributor or other business relationship
Remuneration The candidates first years gross earnings, including all taxable emoluments
Fee The amount due to Abrecco , as per clause 7 of these terms and conditions
Expenses Any costs agreed with the Client, incurred by Abrecco on behalf of the Client

2 The Client shall be deemed to have accepted and be bound by these Terms and Conditions on the first occurrence of:

2.1 The client interviews a candidate introduced by Abrecco or
2.2 The client engages a candidate within 12 months of an introduction by Abrecco or
2.3 The client or a member of the client's staff refers a candidate introduced by Abrecco to some other person, firm or corporate body

3 The client shall be invoiced when the candidate commences employment. All fees and expenses together with the VAT due thereon are payable within 28 days of the invoice date. Abrecco shall be entitled to charge interest on late payments at 4% above the Royal Bank of Scotland's base rate.

4 All introductions are confidential. On the engagement by a third party of a referred candidate, within 12 months of the introduction by Abrecco, the client shall be liable for the fee and any interest due thereon, which will be calculated based on the applicable commencement date.

5 In the event of an engagement being terminated for any lawful reason, within eight weeks of it's commencement and Abrecco informed in writing of such termination, and provided the original invoice was paid on time, a rebate of 12.5% of the Fee will apply for each week of the first eight not worked.

6 Abrecco shall endeavour to ensure the suitability of a Candidate to maintain a high standard of service and integrity but gives no warranty as to that suitability. We shall provide verbal references on candidates, selected for interview, when discretion allows. The client shall be responsible for taking up any references as to the candidate's qualifications, capabilities and integrity and for arranging all medical examinations and for obtaining any work or other permits. Clients should familiarise themselves with all relevant legislation regarding employment of Candidates, as Abrecco cannot accept responsibility for any loss or expense incurred due to any such legislation or as a result of any infringement.

7 The Fee is triggered by an engagement and is proportional to remuneration. Details of our fee scale are available on application.

8 No variation can be made to these Terms and Conditions without the prior written consent of a Director of Abrecco.
